Limitation Of Action In Foreign Economic Contracts
The time limit for limitation of action to request the people's court to protect civil rights is two years, unless otherwise provided by law.
The following limitation period is one year:
(1) compensation for bodily injury; (two) the sale of unqualified goods is not declared; (three) deferred payment or refusal to pay rent; (four) where the deposit is lost or damaged.
The period of limitation of action shall be counted from the time when it is known or ought to know that the right is infringed. However, the people's court shall not protect the rights from infringement for more than twenty years. In case of exceptional circumstances, the people's court may extend the limitation of actions.
When a party exceeds the limitation of action, the parties voluntarily fulfill the limitation of action.
Within the last six months of limitation of action, the limitation of action can not be exercised because of force majeure or other obstacles. The period of limitation of actions shall continue to be calculated from the date of the cancellation of the limitation.
The limitation of action is interrupted by litigation, one party's request or consent to fulfill its obligations. The period of limitation of actions shall be recalculated from the time of interruption.
The limitation of action in civil legal relationship concerning foreign affairs is determined by the applicable law of civil legal relationship established by conflict rules.
