According to the Shanghai Customs on the 14th, Shanghai Customs seized a suspected violation exported to the United States trademark Exclusive right clothing The case is worth about 1.12 million yuan. This is an infringement case with the highest case value seized by Shanghai Customs since the nationwide "Special Action to Combat Infringement of Intellectual Property Rights and Manufacture and Sale of Counterfeit and Inferior Commodities" was launched, and the country of export destination, protected obligee and the country of the applicant is the United States.


On November 16, 2010, Zhangjiagang Jindu Knitting Garment Co., Ltd. declared a batch of clothing goods exported from the United States to the customs of Shanghai Waigaoqiao Port Area. When reviewing the customs declaration of this batch of goods, the customs examiner was sensitive to the risk of infringement of this batch of goods, and issued a control order to verify the name, quantity and whether the goods were infringing.


Shanghai Customs carried out unpacking inspection on this batch of goods and found that the actual export goods were 9279 sets of cotton knitted women's sports suits with the trademark "JUICY", 2336 sets of synthetic knitted men's sports suits with the trademark "PUMA and graphics", and 4843 pieces of chemical fiber knitted cardigans with the trademark "THENORTHFACE and graphics", with a total value of about 1.12 million yuan. After contacting the obligee, the trademark obligee of "JUICY" is L C. The concessionaire, the trademark owner of "PUMA and Graphics", Rudolf Dassler Sporting Goods Poma Co., Ltd. of Germany, and the trademark owner of "THENORTHFACE and Graphics", North Apparel Co., Ltd. of the United States, all confirmed the infringement of the above goods.


In the investigation of the case, Shanghai Customs found that the goods were manufactured and exported by Zhangjiagang Jindu Knitting Garment Co., Ltd. under the entrustment of the American Korean customer ANDYKIM, who provided Zhangjiagang Jindu Knitting Garment Co., Ltd. with chemical fiber knitting sports suits marked "PUMA and graphics" and "THENORTHFACE" The clothing samples of chemical fiber knitted cardigan with trademark "JUICY" and cotton knitted sports suit with trademark "JUICY" are required to be produced by Zhangjiagang Jindu Knitting Garment Co., Ltd. according to the samples, and then exported to the United States, where the American RARECONCEPTINC will receive and clear customs. Zhangjiagang Jindu Knitting Garment Co., Ltd. produced and exported the above goods according to its requirements.


At present, Shanghai Customs is making further investigation on this case.
